Terms of Use

These Terms of Use (the “Terms”) apply to the Streakl mobile application and related website. Streakl is operated by Philipp Romisch.

Acceptance of These Terms

These Terms form part of your agreement when you accept them during sign-up or purchase. You can read them before accepting. If you do not agree, do not complete that process.

Your store's terms also apply: the Apple Standard EULA or Google Play Terms of Service, as applicable. Your statutory consumer rights remain unaffected.

The Streakl Service

Streakl helps you track habits, goals, time, and progress, view statistics, set reminders, and export data. Features and availability may vary by platform, country, and app version.

Streakl is not a medical device, healthcare provider, or emergency service. It does not provide medical advice, diagnosis, or treatment. Do not rely on it for emergencies or safety-critical tasks.

Eligibility and Account Responsibilities

You must be at least 16 years old, or the higher minimum age required in your country, to use Streakl. If applicable law requires consent from a parent or guardian, you may use Streakl only after that consent has been provided.

An account requires a supported Google or Apple sign-in. Keep your device and sign-in account secure, provide accurate information, and contact us promptly if you suspect unauthorised access.

Your Content and Data

You retain ownership of the habits, notes, progress, and other information you enter into Streakl (“Your Content”).

You grant us a limited right to process Your Content to provide, synchronize, secure, and support Streakl, as described in the Privacy Policy. You must have the right to use what you enter; do not submit unlawful content or another person's confidential information without permission.

Streakl stores data on your device and synchronizes it through the service. Device loss, storage removal, account deletion, or service interruptions may affect access. Use the export feature to keep a copy of important information.

Acceptable Use

You may use Streakl only for lawful personal purposes and in accordance with these Terms. You must not:

• interfere with or disrupt Streakl, its security controls, or service infrastructure;
• attempt to access another user's account or data;
• bypass authentication, access, rate-limit, or app-integrity controls;
• reverse engineer or exploit Streakl except where applicable law expressly permits it.

Subscriptions and Payments

Streakl offers auto-renewable subscriptions through the Apple App Store and Google Play. The included features, total price including applicable taxes, billing period, renewal terms, and any offer conditions are shown in the app and store checkout before you confirm a purchase. Availability and eligibility may vary by country, platform, store account, and offer.

The store processes your payment under its terms. Streakl does not receive your full payment-card number. Purchase and access data are described in the Privacy Policy.

Free and promotional access

Eligible accounts may receive limited free or promotional access under the conditions shown in the app. Eligibility can depend on account creation, previous purchases, or earlier offers. Reinstalling or signing in again does not restart a claimed access period.

Free access granted directly by Streakl ends automatically, needs no cancellation, and creates no charge or subscription. A paid subscription requires a separate store purchase. Trials attached to store subscriptions follow the renewal terms disclosed at checkout.

After access expires, tracking and changes require renewed access. You can still view existing habits and statistics, export available data, and manage or delete your account. Tracking and changes may also pause while an internet connection is needed to verify access.

Automatic renewal

Unless you cancel under the applicable store's instructions, a subscription renews for the agreed billing period at the applicable subscription price. Price changes are subject to applicable law and the store's notice and consent requirements. A trial or introductory offer attached to a store subscription may convert to the disclosed paid subscription unless you cancel in time.

Cancellation, refunds, and restore

Manage or cancel your subscription in the purchasing store's subscription settings. Cancellation normally stops the next renewal; access continues for the period shown by the store. Signing out, uninstalling Streakl, or deleting your account does not cancel a subscription.

Store refund policies do not replace statutory withdrawal rights, rights to terminate for cause, or remedies for defective digital products. Withdrawal rights and their expiry depend on applicable law and any express declarations made during checkout. Use the store's process for refunds and billing issues, or contact us for help or to exercise rights against us. We remain responsible for our legal obligations.

Use Restore purchases to recover eligible access. Restoration depends on the store account, supported account linking, and purchase verification.

Notifications and Reminders

Reminders are optional and may be delayed or missed because of network, device, or service conditions. Manage them in Streakl and your device settings; keep an independent record of anything safety-critical.

Intellectual Property

Streakl's software, design, branding, and other materials belong to Philipp Romisch or their respective rights holders.

You receive a personal, limited, non-exclusive, non-transferable right to use Streakl within your agreed access, subject to these Terms and lawful termination. Ownership is not transferred.

Availability and Service Changes

We provide updates required by applicable law and may maintain Streakl to address security, compatibility, and reliability. Temporary interruptions can occur; uninterrupted availability and support for every device or operating-system version are not guaranteed.

During ongoing access, we may make changes beyond those needed to keep Streakl working as agreed to address changes in law, operating systems, third-party interfaces, or technical infrastructure, where legally permitted and without additional cost. We will clearly explain these changes. If a change has more than a minor adverse effect on access or use, we will give advance notice in a form you can keep, such as email, explaining its timing and your statutory right to end the contract without charge. Ending a paid service remains subject to applicable notice, reimbursement, and other consumer rights.

Account Termination

You can stop using Streakl or delete your account at any time. Account deletion does not cancel a store subscription, issue a refund, or erase store purchase history.

We may suspend or terminate access where reasonably necessary for a material breach of these Terms, unlawful conduct, security risks, abuse, or a legal requirement. We will consider the seriousness of the issue and available remedies where appropriate.

Deletion may be irreversible. Some records may remain for the limited purposes described in the Privacy Policy.

Limitation of Liability

Nothing in these Terms excludes statutory warranties, remedies, or consumer rights that cannot lawfully be excluded.

Nothing in these Terms limits liability for intent or gross negligence, injury to life, body, or health, fraudulently concealed defects, expressly given guarantees, applicable product liability, or any other liability that cannot lawfully be limited.

To the extent permitted by law, for slight negligence our liability is limited to breaches of essential contractual duties and to the typical foreseeable damage. An essential duty is one whose performance is necessary for proper performance of the agreement and on which users may ordinarily rely.

Privacy

The Privacy Policy explains how we process personal information and how you can exercise your data-protection rights.

Changes to These Terms

We may propose updated Terms as the law or service changes. They apply to new agreements after acceptance. Changes to existing agreements require a lawful basis and any required notice or consent; publication or continued use alone does not replace required consent or reduce existing purchase rights.

Governing Law and Jurisdiction

German law applies, excluding its conflict-of-laws rules. If you are a consumer, you retain the mandatory protections of the law that would apply without this choice. Mandatory jurisdiction rules remain unaffected; no exclusive venue is imposed on consumers contrary to those rules.
